Frequently asked questions
Plain answers to what government, federally funded organizations, and businesses actually ask before an engagement.
What is the difference between ADA Title II and Title III?
Title II covers state and local government entities; Title III covers private businesses that are places of public accommodation. Government carries documented-program obligations and fixed web deadlines; businesses face litigation risk.
When are the ADA Title II website deadlines?
Public entities with a population of 50,000 or more must conform by April 24, 2027; smaller entities and special districts by April 24, 2028. The standard is WCAG 2.1 Level AA.
Do accessibility overlays or widgets make my site compliant?
No. Overlays do not bring a site into WCAG conformance and do not stop lawsuits — several overlay products have themselves drawn complaints. Documented conformance is what reduces risk.
Can you certify my website as ‘ADA compliant’?
There is no federal ‘Title III compliance certificate.’ What we provide is documented WCAG 2.1 AA conformance — a defensible record of what was tested, found, and fixed.
What standard do you test to?
WCAG 2.1 Level AA — the version incorporated by the DOJ for Title II and by HHS for Section 504. WCAG 2.2 is offered as forward-looking best practice.
What is a VPAT or ACR?
A Voluntary Product Accessibility Template / Accessibility Conformance Report documents how a product measures against accessibility standards. It is completed and signed by an evaluator and is commonly requested in procurement.
Who has to comply with Section 504?
Any program or activity that receives federal financial assistance — including hospitals, universities, and nonprofits. The web obligation has been in force since July 2024.
Do you do physical or architectural accessibility?
No. This practice addresses websites and applications only. Physical and architectural access is coordinated with qualified access specialists.
How quickly can you respond to a demand letter?
Engagements are scoped to move fast when you are already on the clock — beginning with the homepage and the user paths most likely to be cited, then documented conformance.
